E-mail retrieval systems can assist data controllers to respond to subject access requests by instantly accessing e-mails that mention the data subject by name or that are written by or to the subject. These e-mails often include information relating to third parties that may be inextricably linked to the data subject's personal data. This session will look at the application of principles for dealing with third party data in this context: responding to subject access requests for personal data held in e-mail systems; the problem of excessive search results; metadata as third part personal data; withholding third party data; e-mailing with data protection in mind.
